According to the court, the man pushed the victim onto the bed unwillingly and penetrated her with his finger. The girl had run away from her detention home. The convict, however, claimed that sexual intercourse took place, with the girl's consent, and he said that he did not know the girl to be a minor. However, the Appellate Court ruled that the man must have considered that the victim was under 16 years old. The Helsinki Appellate Court increased the sentence of Mika Tapani Jalonen, 31, from one year of unconditional imprisonment to two years of conditional imprisonment. The District Court had previously found Jalonen guilty only of child sexual abuse and dismissed the rape charge. In addition to prison time, Jalonen has to pay the victim 7,000 euros with interest.
