Lawyers in the country have expressed their interest in getting the opportunity of giving feedback to judges.

According to the Finnish Bar Association, at present, providing feedback to judges is almost impossible.

The code of conduct for lawyers prohibits giving inappropriate feedback and demand lawyers to show utmost appreciation towards the judicial authority. Hence, feedback is practically not given at all, said Finnish Bar Association President Risto Sipilä.

According to Sipilä, lawyers also receive little feedback from the courts.

The lawyers pointed out that both constructive and critical feedback are important, so that all the operations can be improved.

The association proposes that the courts systematically begin gathering feedback on an annual basis electronically on inquiries directed to the legal counsels.

The feedback would not take position on judgements but, for instance, should be directed towards issues such as the quality of judgements.

According to Sipilä, the feedback would by no means focus on individual judgements or judges but on the process of supervision and drafting of the judgements.

The association president observes that while feedback collection is nowadays done at some places or through courts development projects, a nationwide system is missing.

The subject of judges’ professionalism and offering them feedback was raised in a survey conducted by Yle in May which was responded to by more than 460 lawyers, legal counsels and public legal assistants.

Of the respondents, 57 per cent believed that giving feedback would give better opportunities in developing the current system.

Nearly 90 per cent of the respondents observed that the judges’ professionalism is not always sufficient in resolving a case.

According to Sipilä, the Bar Association has just discussed the findings of the survey.

“We have a good judiciary and a good judicial system. But, of course, all must always be geared towards the improvement of the operations,” said Sipilä.
